The Saudi legal rule
Delay damages depend on resulting harm. The debtor may establish a cause beyond its control. Check default notice and any applicable statutory or agreed exception, including a written refusal to perform. [1]
What the records establish
For substitute equipment, collect the rental agreement, payments and usage logs. Start the calculation when the site was actually ready to use the delayed machine. If the court appoints an expert, ask it to define the technical question in the order. The expert can compare the baseline with actual progress and allocate delay costs by cause. [4]
Likely defence and next step
Site minutes may show that power arrived two weeks late. Separate that period from supplier-caused downtime and provide an alternative calculation if the readiness date is disputed.
Applicability on 2026-10-30
Published on 19 June 2023, the law took effect on 17 December 2023. [2][3] It applies to commercial transactions where compatible with their nature and no special commercial provision governs. For earlier events, check whether a party invokes a conflicting applicable provision or judicial principle, or a time bar had already begun to run before commencement. [2]
