The Saudi legal rule

A defect at delivery must reduce value or fitness for the intended purpose. The buyer may seek rescission or keep the machine and claim the proportional price difference. The seller can offer an equivalent sound replacement. Inspection and notification rules distinguish apparent and latent defects. The warranty action ordinarily has 180 days from delivery, subject to a longer undertaking or fraudulent concealment. [1]

What the records establish

Record the serial number, operating hours, service history and first alarm. Notify the seller immediately upon discovery of a latent defect and invite inspection before dismantling. Preserve removed components if repair cannot wait. [1] If the court appoints an expert, ask it to define the technical question in the order. The expert can date the failure mechanism and compare the machine’s value with and without the defect. [4]

Likely defence and next step

The supplier may blame operator settings. Ask the technician to separate operational damage from a manufacturing fault. Obtain sound and defective valuations before choosing a remedy, alongside any repair estimate.
