Define the issue
Payments appear for a former employee, an unexplained allowance or a repeated expense claim. A disputed entitlement must be separated from invented information used to obtain money.
What should the company review?
Check entitlement, period, approval, execution date and beneficiary. Reconcile the employee record with appointment, change and departure decisions, then examine bank-detail changes and expense support. A payment after departure may be a legitimate final settlement.
- Entitlement, salary and allowance decisions
- Payroll files and approvals
- Joining and leaving records
- Expense claims and original support
- Beneficiary changes and rejected transfers
Alternative explanations
A delayed HR update, retrospective adjustment or reissue of a rejected payment may explain the entry. Duplicate expense support or a beneficiary change is a review indicator, not proof that an employee or payroll officer appropriated funds.
Legal text and scope
The facts may call for Article 1 of the Anti-Financial Fraud and Breach of Trust Law where appropriation involves deception, or Article 2 where entrusted property and the conduct specified there are involved outside public funds. Characterisation depends on how property was obtained and handled and on the evidence, not on the accounting label. Official Arabic text, Articles 1 and 2.
Professional analysis
Classify differences as unresolved entitlement, execution error or information requiring authenticity checks. Do not automatically withhold entitlements or deduct money because of a screening result. Employment consequences require a separate review; this pathway organises evidence and the initial financial and legal decision.
Hypothetical illustration
Hypothetical example: a travel receipt appears twice, but one claim was cancelled before payment. That differs from two completed payments. Even then, error, knowledge and each participant’s role remain questions to investigate.
A proportionate next step
Preserve originals through lawful authority and need-to-know access. Do not access personal devices or accounts without authority or alter records. Confrontation, reporting, settlement and dismissal are not automatic screening outcomes.
A paid legal consultation can include an initial review of documents within an agreed scope, a meeting to discuss the facts and questions, and a short written summary of options, missing information and the next step in the agreed language. The parties, conflicts, scope and fees must be addressed before work begins. An internal investigation, settlement, complaint or representation requires a separate engagement as needed. Acting for an affected company and defending an individual are separate mandates subject to a conflicts check.
Organise the initial information using NFSh, then see the relevant service.
