Was this preservation work?
A co-owner can take measures to preserve undivided property without the others’ prior consent. Preservation and management costs ordinarily follow ownership shares unless otherwise agreed. This concerns undivided ownership. Separately owned units are subject to their own statutory regime. [1]
Separate prevention from improvement
Ask the contractor to split leak containment and waterproofing from a new roof terrace. Preserve the condition report and receipts. A co-owner may say the expenditure benefited only the floor you occupy. Trace the leak and explain its effect on the shared structure. For a common roof serving subdivided units, maintenance costs follow each unit’s proportion of total subdivided area, subject to variation by use in mixed-use property. An owner-funded improvement requires association approval and must meet the other conditions in article 26(2). [3]
Allocate evidenced expenditure
For each item show the invoice, payment, ownership fractions and any allocation agreement. For a one-quarter share calculate one-quarter of evidenced preservation costs after credits. Offer a joint inspection for disputed technical items before adding upgrades to the demand.
Temporal scope · 2026-10-30
The Law took effect 180 days after official publication. It generally reaches earlier events, except where a party invokes a conflicting pre-existing statutory rule or judicial principle applicable to the event, or a claim-barring period had already started. Separate registration and jurisdiction requirements still apply. [2]
