Match the arrangement to the property

Co-owners can allocate use in proportion to shares by time or by space. A time arrangement sets a start and each owner’s period. A spatial arrangement identifies each owner’s area. While partition is pending, owners may agree interim use or one may ask the court to impose it if agreement fails. [1]

Compare the practical value of use

At a holiday house a festival week and an ordinary week may offer different value. In a two-storey building parking access may differ by floor. Collect occupancy records, entrance plans and meter readings. Test both a calendar and a floor allocation with the owners. Identify whether the agreement allocates occupancy periods only or actually partitions ownership. A partition of title after first registration must be registered. First confirm designation of the area and completion of first registration for this parcel. [3]

Write the changeover terms

Specify key transfers, cleaning costs and treatment of unusable space. Attach a map of common areas. If an owner alleges preferential use, show how duration or space and practical benefit relate to the ownership fraction. Tie the interim arrangement’s end to completion of partition.

Temporal scope · 2026-10-30

The Law took effect 180 days after official publication. It generally reaches earlier events, except where a party invokes a conflicting pre-existing statutory rule or judicial principle applicable to the event, or a claim-barring period had already started. Separate registration and jurisdiction requirements still apply. [2]
