Does handing over a key complete delivery of a Saudi property?

Test a disputed handover against possession, access records and the parties’ agreed delivery terms.

Test whether possession was available

Delivery can occur by possession or by notifying the buyer and actually making unobstructed possession and use available. Check whether the buyer already held the property, whether the parties agreed on an event constituting delivery, or whether the seller remained with consent on a new basis. [1]

Reconstruct the attempted entry

Record when keys arrived and were tested, who occupied the property and why security refused entry. The seller may produce an invitation the buyer ignored. Check receipt and whether the key actually worked on that date. Separate inability to enter from a voluntary decision to move later. A key receipt can evidence handover. A disposition transferring title after first registration must be registered to take legal effect. First confirm designation of the area and completion of first registration for this parcel. [3]

Arrange a joint access check

Set a date to test entrances, transfer access cards and record occupants and meter readings. Write down what changed hands and when each obstacle was removed. This gives both parties a concrete chronology to compare with any broadly worded acknowledgment.

The Law took effect 180 days after official publication. It generally reaches earlier events, except where a party invokes a conflicting pre-existing statutory rule or judicial principle applicable to the event, or a claim-barring period had already started. Separate registration and jurisdiction requirements still apply. [2]
