The Saudi legal rule
With an agreed design and lump sum, higher labour or material prices alone do not increase the fee. For design changes, examine owner fault or owner authorisation together with agreement to increase the fee. Exceptional unforeseeable general circumstances collapsing the contractual balance engage a separate judicial adjustment rule. [1]
What the records establish
Compare original and revised drawings, identifying omissions as well as additions. Retrieve the change instruction, signatory authority and exchange showing what approval meant for price. Preserve the approved variation and the message accepting the specified price increase in digital form for production. An extract carries the record’s evidentiary weight to the extent it matches that record. [4]
Likely defence and next step
If the owner calls the drawing a detail of the original design, identify the original scope item and show how materials or area changed. Price the net change after savings from omitted work.
Applicability on 2026-10-30
Published on 19 June 2023, the law took effect on 17 December 2023. [2][3] It applies to commercial transactions where compatible with their nature and no special commercial provision governs. For earlier events, check whether a party invokes a conflicting applicable provision or judicial principle, or a time bar had already begun to run before commencement. [2]
